Dutch Hauliers vs ULEZ
Transport in Nood BV are representing 10 Dutch hauliers in their legal challenge against their ULEZ fines. If they are successful in this challenge, tens of thousands of pounds worth of fines will be refunded. This will open the door to very similar claims against Transport for London from other hauliers not only in the Netherlands but the rest of Europe.
Transport in Nood are a company that is employed by Dutch hauliers to sort and manage any fines or charges that they receive from the police or governments. Upon researching ULEZ and LEZ fines, they believe that their members have been wrongly issued with over £6.5 million worth of charges.
A case has been submitted by UK law firm Smith, Bowyer and Clarke to the High court. Since November last year the Dutch hauliers have received over 10,000 fines. The Lawyers are arguing that if the fines were received when they happened the drivers would have been able to change their routes to avoid being fined or charged more.
However, for a lot of European hauliers this can be avoided by using trans-shipment depots such as Jonen Shipping who are based just outside the M25.
